What is mailo land

Mailo land is a unique land tenure system found primarily in Uganda, originating from the 1900 Buganda Agreement between the British colonial government and the Kingdom of Buganda. Under this system, large tracts of land were allocated to the Kabaka (king), chiefs, and private individuals, who were given perpetual ownership rights similar to freehold. Unlike other forms of tenure, mailo land often has “bibanja” holders—tenants with customary rights to occupy and use the land, creating a layered ownership structure. This arrangement has led to complex legal and social dynamics, as landlords hold title deeds but cannot easily evict long-standing occupants. Today, mailo land is both a source of economic opportunity and persistent conflict, with disputes over boundaries, inheritance, and tenant rights frequently arising. Its blend of traditional authority, colonial legacy, and modern legal frameworks makes mailo land one of the most distinctive and debated land systems in Africa.
